Pensions are often one of the most significant assets owned by a married couple. There can be a number of factors for consideration when asking the Court to deal with the sharing of a pension. In addition, there are lots of different types of pensions, the rules relating to each can vary.

The Court are able to make a number of orders where pensions are concerned, including:

  • Pension Sharing Order – This is where the pension of one spouse is divided creating a new separate pension fund for the other spouse.
  • Pension Attachment Order (against income) – This is where some or all of the income from the pension is redirected following retirement.
  • Pension Attachment Order (against a lump sum) – It is possible to redirect a portion of the entirety of a lump sum, payable on retirement.
  • Pension Attachment Order (against death benefit) – For some pensions’ death benefit may be redirected in whole or in part to a former spouse.

Of course, these are just some of the orders the Court can make or can be arranged between the parties during negotiation and settlement.
